Packster Terms of Service

Effective Date: 2 March 2026

IMPORTANT: PLEASE READ THESE TERMS OF SERVICE CAREFULLY.

By accessing or using Packster (the "Service"), including the web app, AI features, or related tools provided by Packster Pty Ltd (ACN: TBC / TBD, "Packster," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use the Service.

These Terms form a binding legal agreement between you and Packster Pty Ltd. We may update them from time to time (see Section 13). Continued use after changes constitutes acceptance.

1. Definitions

  • "AI Content": Packing lists, suggestions, chat responses, or other outputs generated using GPT-4o (Paid Tiers) or GPT-4o-mini (Free Tier) based on your inputs.
  • "Content": Any trip data, preferences, lists, images, feedback, or materials you upload or input.
  • "Free Tier": $0 access limited to 1 trip, GPT-4o-mini, basic weather.
  • "Paid Tiers": Per Trip ($2.99 one-time for +1 trip), Monthly ($4.99/mo unlimited), or Annual ($19.99/yr or $14.99 first-year intro, then $19.99/yr) — all with GPT-4o and full features (including PDF export, wardrobe tools, etc. when implemented).
  • "Pricing Page": The in-app or website page showing current plans and pricing (subject to change with notice).
  • "Service": Packster web app, AI-powered packing lists, trip planning, sharing links, weather integration (Open-Meteo), and related features.
  • "Third-Party Providers": Includes OpenAI (AI inference via standard API), Open-Meteo (weather), Supabase (auth/storage), and Stripe (payments).

2. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. You are responsible for your account security and all activity under it. We may suspend or terminate accounts for violations.

3. Description of Service and Tiered Features

Packster generates AI-powered packing lists and trip suggestions based on your inputs (destination, dates, activities, travellers, etc.).

Tiers (full details on Pricing Page):

  • Free Tier: 1 trip, GPT-4o-mini, basic weather integration, no ads.
  • Paid Tiers: Unlimited trips (or +1 per one-time purchase), GPT-4o ("Full AI"), AI chat, multi-traveller support, sharing links, templates, wardrobe outfits, cross-trip learning, PDF export (backlog; when implemented), priority AI processing (when implemented), and future PRO features (e.g., packing history, trip reminders, analytics, wardrobe image upload/AI identification, smart categories, outfit generation, pack verification camera, multi-stop trips, travel document checklists, medication intelligence, airline baggage integration, gamification, cultural intelligence, etc. — all backlog and subject to future release).

Features, limits, pricing, and AI models may change. Paid subscriptions auto-renew unless cancelled.

Critical AI & Travel Disclaimers

Packing lists and other AI Content are general in nature and are provided for informational use only. You should review all such content for correctness, completeness, and suitability for your specific trip before relying on it. AI Content and weather data are suggestive and informational only — not guaranteed accurate, complete, current, or suitable for your trip. AI can produce errors, hallucinations, or omissions. Weather forecasts (via Open-Meteo) decrease in reliability over time (e.g., generally lower accuracy beyond 5–7 days).

You must independently verify all information before travel, including:

  • Airline, security (TSA/equivalent), customs, and destination rules on prohibited/restricted items (e.g., lithium batteries placement, liquids >100 ml in carry-on, sharp objects).
  • Safety gear and requirements for activities (e.g., helmets/life jackets for skiing/hiking/water sports, specific equipment).
  • Health/medical needs (allergies, medications, vaccinations) — consult professionals.
  • Entry requirements (visas, vaccinations, health declarations) — check official sources (e.g., Smart Traveller [Australia], U.S. State Department, EU travel sites, WHO, IATA).
  • Actual weather conditions vs. forecasts.

The Service is not professional travel, legal, medical, safety, financial, or advisory service. We are not liable for consequences from reliance on AI Content, weather data, or future features (e.g., weight estimation, document checklists, medication intelligence). You alone are responsible for packing decisions, compliance with laws, and safe travel.

AI-Generated Content Transparency (EU AI Act)

In accordance with Article 50 of the EU Artificial Intelligence Act (Regulation (EU) 2024/1689), packing lists, suggestions, chat responses, and other outputs produced by the Service are generated by an AI system (OpenAI GPT-4o or GPT-4o-mini). Such outputs are machine-generated and labelled as AI-generated within the Service. They do not represent professional advice. You are solely responsible for verifying and acting on any AI-generated content.

4. User Content, Licenses & Data Handling

You retain ownership of your Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, process, reproduce, and use your Content (and resulting AI Content) solely to provide and operate the Service, including sending inputs to OpenAI for inference.

Important AI Data Facts

  • Packster does not train or fine-tune any AI models on your data.
  • AI features use OpenAI's standard API: your inputs/outputs are not used by OpenAI to train or improve models (per OpenAI policy effective since March 2023; no opt-in by us). OpenAI may retain inputs/outputs for up to 30 days for abuse/safety monitoring, after which they are deleted (unless legally required otherwise).
  • Account deletion removes your trips, lists, profiles, and chat history from our systems within 30 days (subject to legal holds/backups).

You represent your Content is lawful and non-infringing. We may remove violating Content.

AI Content Ownership: You own the specific AI Content generated for you. Similar outputs may appear for others. You grant us the same licence in AI Content. You may not use AI Content to train competing models or scrape systematically.

Sharing Links (Paid Tiers only): Token-based, viewer-only (view, check off, add items), revocable, expire on trip completion/cancellation or your set expiry. No public/community publishing. Future collaborative/family hub features (backlog) will be governed by these Terms.

5. Acceptable Use

Use the Service only for lawful personal trip planning. Prohibited: illegal/harmful use, reverse-engineering, reselling/scraping outputs, uploading infringing/harmful Content, bypassing limits, or misusing sharing/future features.

We may monitor and suspend for violations.

6. Subscriptions, Payments & Refunds

Payments via Stripe (secure).

  • Per Trip: One-time, non-recurring.
  • Monthly/Annual: Recurring; cancel anytime via account settings (access to end of billing period).

Prices/taxes as shown; changes with notice.

Refunds: Fees are generally non-refundable. Specifically:

  • No refunds on Per Trip purchases once a packing list has been generated.
  • No refunds on Monthly/Annual subscriptions once a trip has been generated in the billing period.

We may offer discretionary refunds/credits. Statutory rights are preserved — including Australian Consumer Law (ACL) remedies for major failures, and the EU 14-day right of withdrawal for distance contracts where applicable. The right of withdrawal is lost once you have accessed the digital service with your prior acknowledgment that the withdrawal right will be forfeited upon commencement of performance. No automatic cooling-off applies to digital services after access.

7. Intellectual Property

Service technology, branding, and underlying elements (excluding your Content) owned by us/licensors. Limited revocable licence granted for permitted use.

8. Privacy & Cookies

See our Privacy Policy for details on data collection, OpenAI processing, retention (including 30-day deletion post-account erase), third-party sharing, cookies, and your rights (GDPR, Australian Privacy Principles, CCPA, etc.). We use analytics cookies (PostHog) only with your explicit consent, granted via the cookie consent banner displayed on your first visit.

9. Disclaimers and Warranties

THE SERVICE, AI CONTENT, WEATHER DATA, AND ALL FEATURES (INCLUDING FUTURE BACKLOG ITEMS) ARE "AS IS"/"AS AVAILABLE" WITHOUT WARRANTIES (EXPRESS/IMPLIED), INCLUDING ACCURACY, RELIABILITY, FITNESS, OR NON-INFRINGEMENT. NO WARRANTY OF UNINTERRUPTED/ERROR-FREE OPERATION.

10. Limitation of Liability

To the maximum extent permitted by law (including Australian Consumer Law, EU consumer rights):

  • No liability for indirect, incidental, consequential, punitive, or exemplary damages (e.g., travel losses, replacement costs).
  • Total aggregate liability limited to the greater of (i) amounts paid by you in the 12 months preceding the claim or (ii) AUD 100.

Nothing excludes liability for death/personal injury from negligence, fraud, or prohibited mandatory law.

11. Indemnification

You indemnify us against claims/losses/expenses (including legal fees) from your use of Service/AI Content, Content, packing/travel decisions, or breaches.

12. Termination

We may suspend/terminate access anytime for cause. You may stop use and request account deletion at any time via account settings. Surviving sections: 4, 7, 9–11, 14, 17.

13. Changes to Service or Terms

We may modify the Service or these Terms at any time. Material changes will be notified via email or in-app notice with reasonable advance notice. Continued use after the effective date of changes constitutes acceptance. Stop use and request account deletion if you disagree with any changes.

14. Governing Law and Dispute Resolution

Governed by laws of Queensland, Australia (no conflict rules).

Disputes: Informal resolution first (contact us at support@packster.app). Exclusive jurisdiction of Queensland courts (or arbitration in Brisbane under Australian Disputes Centre rules, individual basis, no class actions where permitted).

Consumer rights under your residence law are preserved (e.g., Australian Consumer Law, EU consumer rights). EU users: The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

15. Miscellaneous

Severability, no waiver, entire agreement, force majeure, export compliance, assignment (we may assign; you may not without consent), English controls.
